Starting a Business in Anguilla as a Non-Anguillian

Non-Anguillian applicants can establish and operate businesses in Anguilla, but the route is not identical to the local small-business path. The Licensing of Businesses Act distinguishes Anguillian and non-Anguillian applicants and can impose additional documentation, ownership and structural requirements.

Enhanced application documents

Non-Anguillian business-licence applications commonly require additional character, police and financial-reference documentation. The Commerce Unit can also require evidence relating to premises, planning, land, qualifications or other activity-specific approvals.

Reserved industries and joint ownership

Where an industry is reserved for local enterprise, ownership rules must be checked before the investment is structured. The Act also requires incorporation where a business is jointly owned by an Anguillian and a non-Anguillian. Do not assume that an ordinary general partnership is available simply because it would be cheaper.

Land, residence and work permission

A business licence is not a work permit, residence permission or Alien Land Holding Licence. These issues should be scoped separately before acquiring land, entering a long-term property arrangement or assuming that an overseas owner can work in the business immediately.

Practical sequence

  1. Confirm the activity and ownership route.
  2. Check reserved-industry and land implications.
  3. Choose the legal structure and professional service providers required.
  4. Prepare enhanced due diligence and the business plan.
  5. Complete entity formation where required, then business licensing and sector approvals.
  6. Resolve banking, work-permit, tax and payroll setup before launch.
